This page has two parts: 1. A Disclaimer that applies to everyone who uses twowheeltouring.com, our Ride Files, and our videos. 2. The Release of Liability, Assumption of Risk, Waiver and Hold Harmless Agreement that every Guided Ride participant and equipment renter must sign before riding.

See also our Terms and Conditions.

Part 1: Disclaimer

For information only. Route descriptions, GPX files, maps, ride reports, blog posts, photos, and videos (including on our YouTube, Facebook, and Instagram) are shared for general information and entertainment. They are not a guarantee that a road is open, legal to ride, passable, or safe.

Riding is dangerous. Motorcycling, especially on mountain, backcountry, gravel, and dirt roads, carries a real risk of serious injury, permanent disability, and death. No route, video, or tip can remove that risk.

Conditions change. Roads close. Gates get locked. Private property and land-access rules change. Snow, ice, wildfire, smoke, floods, rockfall, washouts, construction, livestock, wildlife, and traffic can turn a good road dangerous. Our information may be inaccurate, incomplete, or out of date the day you ride. Check current road, weather, fire, and closure information from official sources before every trip.

No warranty. All content is provided "as is," with no warranty of accuracy, completeness, or fitness for any purpose. GPS devices and apps may route differently from our files.

Not professional advice. Nothing we publish is professional riding instruction, mechanical, medical, legal, or navigation advice. What you see in our videos is what we chose to do, in that moment, with our skills and bikes. It is not a suggestion that you do the same. Get proper training, ride within your limits, and keep your bike maintained.

Obey the law. Follow all traffic laws, posted signs, speed limits, and land-use and off-highway vehicle rules. Never trespass. Some footage may show closed courses, private property with permission, or riding that isn't legal or wise for you to copy.

Ride at your own risk. You alone are responsible for your decisions, your riding, and your bike. To the fullest extent the law allows, Two Wheel Touring is not liable for any injury, loss, damage, citation, or cost that results from your use of our routes, files, or content.

Part 2: Release of Liability, Assumption of Risk, Waiver and Hold Harmless Agreement

PLEASE READ CAREFULLY. THIS IS A LEGAL CONTRACT. BY SIGNING IT YOU GIVE UP IMPORTANT LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE TWO WHEEL TOURING FOR INJURY, DEATH, OR PROPERTY DAMAGE CAUSED BY ITS ORDINARY NEGLIGENCE.

This Agreement is between me, the Participant named below, and [legal business name and entity type], doing business as Two Wheel Touring ("Two Wheel Touring"). It covers every guided ride, ride-along, documentation session (photo, video, drone, mounted cameras, intercom audio), and equipment rental I take part in with Two Wheel Touring, including related meetups, stops, and travel ("the Activities").

1. Age and eligibility

I am at least 18 years old. Minors may not take part. I hold a valid motorcycle license or endorsement. I ride my own registered, insured, street-legal motorcycle. I meet the rider requirements in the Terms and Conditions.

2. Voluntary participation

I take part in the Activities voluntarily. I'm not required to, and I may stop at any time.

3. Risks I understand

I understand that motorcycling and the Activities are inherently dangerous and can result in serious bodily injury, paralysis, permanent disability, death, and damage to or loss of property. Risks include, but are not limited to:

  • Crashes, falls, and loss of control, including at low speed, while stopped, or while riding off-pavement.

  • Other vehicles, drivers, cyclists, pedestrians, livestock, and wildlife (including deer).

  • Road hazards: gravel, sand, oil, wet leaves, potholes, cracks, tar snakes, painted lines, cattle guards, debris, blind curves, narrow or one-lane roads, steep grades, drop-offs, missing guardrails, washouts, rockfall, water crossings, and unmaintained or dirt roads.

  • Weather and environment: heat, cold, rain, fog, wind, ice, snow, high altitude, sun glare, darkness, wildfire, and smoke.

  • Remote areas with no cell service and delayed emergency medical response.

  • Mechanical failure of my own motorcycle or gear, including tires, brakes, chain, and electrical systems.

  • Riding in a group: following too closely, unfamiliar pace, target fixation, and copying another rider's choices.

  • My own fatigue, dehydration, inexperience, errors in judgment, and medical conditions.

  • Distraction from intercoms, cameras, and mounts. Mounts can loosen, fall, or damage my bike or helmet.

  • Drones flying nearby, including the risk of distraction or contact.

  • The ordinary negligence of Two Wheel Touring, its guides, or crew, including choice of route, pace, instructions, stop locations, mounting of equipment, or failure to warn.

4. Assumption of risk

I KNOWINGLY AND VOLUNTARILY ASSUME ALL OF THESE RISKS, KNOWN AND UNKNOWN, EVEN IF THEY ARISE FROM THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES. I accept full responsibility for my own safety, my riding, and my decisions. Guides lead the route. They do not control my riding. I'll ride within my abilities, obey all laws, and stop or turn back if I feel unsafe.

5. Release and waiver

TO THE FULLEST EXTENT ALLOWED BY CALIFORNIA LAW, I RELEASE, WAIVE, DISCHARGE, AND PROMISE NOT TO SUE Two Wheel Touring and its owners, members, officers, guides (including Steve and Mike), crew and mechanics (including Jesse), employees, contractors, volunteers, successors, and assigns (the "Released Parties") for any and all claims, demands, losses, or causes of action arising from or related to the Activities, INCLUDING CLAIMS CAUSED IN WHOLE OR IN PART BY THE ORDINARY NEGLIGENCE OF ANY RELEASED PARTY. This covers personal injury, illness, death, and property damage.

What this does not release: I am not releasing claims for gross negligence, fraud, willful or intentional misconduct, or violation of law by a Released Party, or any claim that California law does not allow to be waived.

6. Indemnity and hold harmless

I agree to indemnify, defend, and hold harmless the Released Parties from any claims, damages, costs, and reasonable attorneys' fees brought by me, my family, my estate, my passengers, or any third party (including other riders, drivers, and property owners), to the extent they arise from my riding, conduct, motorcycle, violation of law, or breach of this Agreement, except to the extent caused by a Released Party's gross negligence or willful misconduct.

7. Medical treatment consent

I consent to Two Wheel Touring and its guides calling emergency services and arranging or giving first aid and emergency medical treatment and transport for me if they believe I need it. Guides are not medical professionals and have no duty to give care. I am responsible for all costs of medical care, rescue, evacuation, and transport. I have told Two Wheel Touring about any medical condition, allergy, or medication that could affect my riding or care.

8. My own insurance

I carry, and am responsible for, my own health insurance and the motorcycle liability insurance California requires. I understand Two Wheel Touring does not provide health, accident, or vehicle insurance for me or my motorcycle. I'm encouraged to carry uninsured/underinsured motorist, collision, and medical-payments coverage.

9. My motorcycle and gear

I alone am responsible for the condition, maintenance, legality, and operation of my motorcycle and my riding gear, including a DOT-compliant helmet. Any comment, inspection, adjustment, or help from a guide or mechanic (including Jesse "The Wiz") is a courtesy only. It does not make Two Wheel Touring responsible for my bike's condition or performance. Two Wheel Touring may refuse or end my participation if it believes my bike, gear, condition, or riding is unsafe.

10. Rented equipment

If I rent equipment, I accept the rental terms in the Terms and Conditions. I'm responsible for the gear until it's returned, including loss and damage up to replacement cost. Mounting cameras or devices on my motorcycle or helmet is at my own risk.

11. Media release

I grant Two Wheel Touring permission to record and use my image, likeness, voice, and motorcycle in photos, video, drone footage, and intercom audio made during the Activities, for its website, YouTube, social media, and promotion, without payment, unless I opt out in writing as described in the Terms and Conditions. Intercom audio is recorded only with my consent.

12. Severability

This Agreement is meant to be as broad as California law allows. If any part is found unenforceable, the rest stays in full force. The unenforceable part will be limited only as much as needed to make it enforceable.

13. Governing law and venue

This Agreement is governed by the laws of the State of California. Any dispute will be brought only in the state or federal courts in Napa County, California.

14. Entire agreement and duration

This Agreement, together with the Terms and Conditions, is the complete agreement on its subject. It applies to the Activities on the date below and to any future Activities with Two Wheel Touring unless I revoke it in writing, which also ends my participation. It binds me, my heirs, my next of kin, my personal representatives, and my estate.

15. Acknowledgement

I HAVE READ THIS ENTIRE AGREEMENT. I UNDERSTAND IT IS A BINDING CONTRACT, AND THAT BY SIGNING IT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING MY RIGHT TO SUE FOR ORDINARY NEGLIGENCE. I AM AT LEAST 18 YEARS OLD. I HAD THE CHANCE TO ASK QUESTIONS AND TO HAVE A LAWYER REVIEW IT. I SIGN IT FREELY AND VOLUNTARILY, AND NO PROMISES WERE MADE TO ME BEYOND WHAT IS WRITTEN HERE.
